Terms and conditions of use
  • 1. Definitions

    Author: any natural person who has created elements present on this site, in particular authors of texts, graphic designers, layout artists and designers of the tree structure.
    Browser: client software used to connect to websites.
    Producers: owners of the Site, in accordance with art. L.341-1 al.1 of the French Intellectual Property Code.
    Site: all resources accessible under the argeles-sur-mer.com domain name.
    User: visitor to this Site and consumer of its information.

  • 2. Database law

    2.1 The entire Site is defined as a database within the meaning of the directive of March 11, 1996 and its transposition into French law in the law of July 1, 1998 (art.L.341-1 et seq.). As such, the Producer authorizes exclusively the uses and accesses defined in paragraph 3. Copyright below.
    2.2 Any use or extraction of elements of the Site not authorized by the Producer is unlawful and punishable by the offence of counterfeiting referred to below.

  • 3. Copyright

    3.1 All elements of the Site, in particular: graphics, wallpapers, images, logos, bullets and descriptive elements, are also the subject of an intellectual property right of the Producer under copyright on these elements or on the site as a work of authorship or as a database.
    3.2 All texts reproduced on the Site are the property of their authors. Use of these texts is subject to the usual conditions of copyright as defined by the French Intellectual Property Code, and in compliance with the Berne Convention and subsequent international agreements, except as mentioned in the following paragraph.
    3.3 Any other use of the content present on the Site requires the agreement of the Producers and Authors concerned.
    3.4 Any use, even on a private basis, of all or a substantial part of the Site requires the agreement of the Producers, in accordance with the provisions of art. L.342-1 of the French Intellectual Property Code.
    3.5 Any infringement of copyright or database law is punishable by criminal penalties for counterfeiting, without prejudice to any claims for damages from the rights holders.

    5.1 A link to the Site may only be set up with the written consent of the Producers. Requests for a link to the Site must be made by e-mail using our contact form.
    5.2 The use of a link may only be granted to sites related to the municipal institution and its usual partners, tourism, tourism-related activities, search engines, as well as sites referring to the commune of Argelès-sur-Mer, to the exclusion of those disseminating information of a polemical, pornographic or xenophobic nature or which may, to a greater extent, offend the sensibilities of the majority.
    5.3 In all cases, the Producers reserve the right to request the removal of a link if they consider that the referring site does not comply with the rules defined above.
    5.4 Referring sites must keep the Producers informed of important developments and modifications to their content, and, where appropriate, of the removal of the link.
    5.5 The Producers reserve the right to withdraw their authorization for a link at any time, without having to specify the reason to the site concerned.
    5.6 The Producers reserve the right to “point” to third-party sites. By accessing these links, the User leaves the Site. The target sites are not under the control of the Producers, who are therefore not responsible for the content of these sites, the links they contain or any changes or updates made to them.
    5.7 In the event that “outgoing” links lead to generalist sites, the Producers reserve the right to modify the link so that it directs the User to the page(s) concerning the commune of Argelès-sur-Mer.

    PERSONAL DATA PROTECTION CHARTER

    In accordance with European Regulation 2016/679 of April 27, 2016.

    (Known as the “General Data Protection Regulation” or RGPD).

    This personal data protection charter (hereinafter: the “Charter”) describes the commitment of site www.argeles-sur-mer.com of the Office de Tourisme d’Argelès-sur-Mer, Place de l’Europe 66700 Argelès-sur-Mer SIRET 776 129 306 00010 edited by Mr. Jean-Florent Boineau as data controller with regard to respect for the privacy and protection of personal data of its users. This Charter has been drawn up to inform you of the practices and conditions under which the Argelès-sur-Mer Tourist Office collects, uses and stores your personal data (hereinafter referred to as the “Data”).

    You will find a description of the various “Data” that we may collect and process or that you may transmit to us when you access and/or use the http://www.argeles-sur-mer.com website (the “Site”). The term “Site” refers only to the http://www.argeles-sur-mer.com website.

    Given the constant evolution of laws and regulations concerning technology and the protection of personal data, it is likely that this Charter will be updated. If you are a user of the Site, you will be informed of any changes by e-mail.

    Should any clause of the present Charter be declared invalid or contrary to regulations, it will be deemed unwritten, but this will not invalidate the other clauses of the present Charter.

    The present Charter applies to “Data collected”:

    WHAT DATA IS COLLECTED BY SITE NAME?
    Depending on the nature and purpose of your interaction with the Office de Tourisme d’Argelès-sur-Mer (creation of a user account, subscription to the Newsletter, completion of contact forms, and any telephone exchanges) we may collect the following Data:

    HOW IS YOUR DATA COLLECTED?
    Data may be collected in various ways on the Site. Data may be collected directly when you transfer it to us using the contact and user account creation forms, newsletter registration forms available on the Site and/or communicated when you contact us by telephone. When you contact us by these different means, a copy of your exchanges with the Office de Tourisme d’Argelès-sur-Mer, including e-mail addresses, may be made and archived. L’Office de Tourisme d’Argelès-sur-Mer also collects certain Data indirectly by means of cookies/trackers.

    WHY IS YOUR DATA COLLECTED?
    If you are an ordinary user, we collect your Data in order to :

    Send you our newsletter and/or personalized commercial offers if you have given your consent.
    Manage your requests sent via the contact page.
    Allow you to leave a review of products and/or the Site.
    Inform you of changes concerning the Site or our products and services.

    What is a cookie?

    A cookie is a text file recorded on the hard disk of your terminal (computer or telephone) at the request of the server managing the visited website.     WHO PROCESSES YOUR DATA?
    Your Data is processed by the staff and collaborators of the Argelès-sur-Mer Tourist Office in charge of :

    Managing information requests
    Support management, to answer all your questions.
    Sending the newsletter if you have authorized us to do so.
    In addition, within the framework of our activity, and for processing purposes, your Data may be communicated to subcontractors, service providers or other third parties, and in particular :

    Mailjet SAS (for emailing).
    “Google Analytics (for site audience analysis).
    Each of these parties is bound by a confidentiality agreement concerning the use and processing of personal data.

    To send out our Newsletters, our e-mailing campaigns are managed by Mailjet SAS 13-13 bis, rue de l’Aubrac – 75012 Paris, France.

    All of the above-mentioned subcontractors, service providers, partners and other third parties are bound by contractual obligations to respect the confidentiality and protection of Data and to process it solely for the purposes for which we transmit it to them.

    Your Data may be transferred to any purchaser or other successor in the event of a merger, assignment, restructuring, reorganization, dissolution or other sale or transfer of some or all of the assets of the Office de Tourisme d’Argelès-sur-Mer, due to uncertainties or bankruptcy, liquidation or other processes in which the Data of users of the Office de Tourisme d’Argelès-sur-Mer are among the assets transferred.

    Finally, we may also disclose your Data:

    To comply with any mandate required by applicable law, including governmental and regulatory requests.
    If we believe that disclosure is necessary or required to protect the rights, property or safety of Office de Tourisme d’Argelès-sur-Mer, its customers or other stakeholders.

    HOW LONG IS YOUR DATA STORED?
    L’Office de Tourisme d’Argelès-sur-Mer only keeps your Data for as long as is necessary for the purposes set out in Article 3. This retention period varies according to the Data in question, as the nature and purpose of the collection may vary. Similarly, certain legal obligations impose a specific retention period.

    When you subscribe to our newsletter, we keep your e-mail address until you unsubscribe.

    When you contact the Office de Tourisme d’Argelès-sur-Mer using the contact form or when you contact us by telephone, your data may be kept:

    – up to one (1) year from the last contact if you do not have a customer account or have placed an order on the site or with our company.

    – up to ten (10) years (legal period) from the last order placed on the Site, if this information concerns this order.

    – In all other cases, the Data exchanged will be kept for no longer than three (3) years.

    If you request the deletion of Personal Data, your user account on the Site will be deactivated and anonymized, and then completely deleted at the end of the aforementioned periods from the day on which you made the request. Lastly, data collected by means of cookies or tracers will be kept for up to six (6) months in the case of audience measurement cookies or tracers, and for up to thirteen (13) months in the case of other cookies or tracers. Beyond the above-mentioned retention periods, your Data will be anonymized and stored exclusively for statistical purposes.

    HOW IS YOUR DATA PROTECTED?
    Your Data is stored on a secure server protected by a firewall and antivirus software. We have implemented technical and organizational measures to guarantee the security and confidentiality of your Data against accidental loss and against unauthorized access, use, modification and disclosure. However, given the inherent characteristics of the Internet, it is impossible for us to guarantee the optimal security of information exchanges on this network. While we strive to protect your Data, we cannot guarantee the absolute security of information transmitted to the Site. You agree that you transmit your Data at your own risk. We cannot be held responsible for non-compliance with confidentiality parameters or security measures in place on the Site. As such, you agree that the security of your information is also your responsibility. For example, it is your responsibility to keep secret the password that gives you access to your user account. Do not, under any circumstances, divulge it to third parties. Similarly, be careful when disclosing information in the public sections of the Site, as these can be consulted by any user of the Site.

    WHAT ARE YOUR RIGHTS?
    You can choose how the Data you transmit to us is used:

    In addition, subject to the conditions laid down by the aforementioned regulations for the exercise of these rights, you benefit from :

    The right to erase your Data (except for accounting data, which must be kept for 10 years under French law – article L123-22 of the French Commercial Code).
    The right to limit the processing of your Data.
    A right to object to the processing of your Data for legitimate reasons, in accordance with Article 21 of the RGPD.
    A right to portability of the Data you have provided (for automated processing based on consent or the performance of a contract).
    Of the right to withdraw consent, where this has been requested from you. Where the processing of your Data is carried out on the basis of your consent, you may withdraw it at any time.
    You acknowledge, however, that any processing carried out prior to the withdrawal of your consent remains perfectly valid. You also have the right to object, without giving any reason, to the Office de Tourisme d’Argelès-sur-Mer analyzing your Data in order to share it for marketing purposes.

    However, in accordance with Article 12.6 of the RGPD, in order to exercise these rights, Office de Tourisme d’Argelès-sur-Mer as the party responsible for this processing, reserves the right to ask you to provide proof of your identity. We inform you that the data used to justify your identity will be deleted once we have responded to your request.     We have a period of one month to respond to any request relating to the exercise of your rights. This period may be extended by two months if the request is too complex or too numerous.

    STORAGE OF DATA COLLECTED BY THE ARGELES-SUR-MER TOURIST OFFICE
    Data collected in connection with use of the Site is stored exclusively on a server located in Europe (France), hosted by the company RACCOURCI AGENCY 18 bvd Maréchal Lyautey, 17000 La Rochelle.

  • 7. Liability

    7.1 The contents presented on the Site are the sole responsibility of their Authors. The information, comments and opinions contained therein are their sole responsibility. The Producers may not be held liable for the latter.
    7.2 The Producers cannot be held responsible for material errors that may have crept into the documents on the Site, despite the care taken in their publication.
    7.3 Nor can the Producers be held responsible for information, comments and opinions expressed on sites to which they link via hypertext links and over which they have no editorial control.
    7.4 Nor can the Producers be held responsible for faulty data transmission due to the various Internet networks or incompatibilities due to the User’s browser.
